Au prisme de l’autonomie de la volonté, le contrat a toujours été considéré comme l’affaire des parties, une sorte de microcosme prohibant tout interventionnisme extérieur. Les parties à un contrat étaient considérées comme les seuls garants et meilleurs juges de leurs intérêts. C’est le principe d’interdiction de l’immixtion du juge dans les relations entre particuliers. Avec l’ordonnance n°2016-131 du 10 février 2016 portant réforme du droit des contrats, du régime général et de la preuve des obligations ratifié le 20 avril 2018, nous assistons à une certaine mainmise du juge dans le contrat. A travers une analyse synoptique de ce nouveau droit commun des contrats, l’on s’accorde pour constater que son office a été renouvelé et revigoré en amont comme en aval nonobstant le renforcement de prérogatives individuelles des cocontractants. Le droit actuel semble crée « un couple légitime » entre le juge et le contrat.

En effet, si certaines dispositions semble déceler l’intervention minimaliste du juge dans le contrat (avec l’évènement de l’unilatéralisme dans le droit des contrats à travers les actions interrogatoires, la rupture unilatérale du contrat, l’exception d’inexécution anticipée, la fixation unilatérale du prix ou sa réduction etc.), d’autres par contre attestent des prérogatives élaborées du juge dans l’environnement contractuel. Il s’agit notamment les dispositions relatives à l’obligation précontractuelle d’information et l’appréciation de ses critères; l’exécution forcée des avant-contrats; la révision judiciaire du contrat pour imprévision; le contrôle de l’exercice des prérogatives individuelles reconnues aux parties; la prolifération des standards juridiques tels que le déséquilibre significatif, le manifeste, le raisonnable, l’illusoire ou le dérisoire; l’érection légale de la bonne foi comme nouveau principe directeur du droit des contrats. La détermination du contenu du contrat semble désormais être le fruit une œuvre collective. Jadis considéré comme « l’ennemi numéro un du contrat » au prisme de la liberté contractuelle et de la force obligatoire du contrat, le juge semble désormais avoir une certaine marge de manœuvre pour venir au secours du contrat selon sa nature ou la situation de la personne contractante. Dans le droit actuel, le législateur formalise de manière substantielle les prérogatives du juge qui interviendra fréquemment dans l’univers contractuel. Il est désormais devenu un acteur permanent de l’avenir du droit français contemporain des contrats. Il dispose d’un certain pouvoir de modulation et d’adaptation du contrat à la circonstance crée ou en fonction des circonstances. Ces prérogatives semblent faire de lui l’agent qui viendra au secours de l’efficacité contractuelle et de la pérennité contractuelle si besoin en est. Cette thèse aura pour but de démonter à travers la réforme, la place variable et la finalité multiple de l’intervention du juge dans la sphère contractuelle tout en déterminant les contours et détours du raffermissement de son office dans l’optique de voir si l’étendue de son interventionnisme est satisfaisant.

At the prism of the autonomy of the will, the contract has always been considered as the affair of the parties, a sort of microcosm prohibiting any outside interventionism. The parties to a contract were considered the only guarantors and best judges of their interests. This is the principle of prohibiting the interference of the judge in relations between individuals. With the order n ° 2016-131 of February 10th, 2016 reforming the law of the contracts, the general system and the proof of the obligations ratified on april 20; 2018, we are witnessing a certain control of the judge in the contract. Through a synoptic analysis of this new common law of contracts, it is agreed that its office has been renewed and reinvigorated upstream and downstream, despite the reinforcement of the individual prerogatives of the contracting parties. The current law seems to create ‘a legitimate couple’ between the judge and the contract.

Indeed, if certain provisions seem to detect the minimalist intervention of the judge in the contract (with the event of unilateralism in the law of the contracts through the interrogatory actions, the unilateral rupture of the contract, the exception of anticipated non-performance , unilateral price fixing or reduction etc.), while others attest to the elaborate prerogatives of the judge in the contractual environment. These include the provisions relating to the pre-contractual information obligation and the assessment of its criteria; forced execution of pre-contracts; judicial review of the contract for unforeseen circumstances; the control of the exercise of the individual prerogatives recognized by the parties; the proliferation of legal standards such as significant imbalance, manifest, reasonable, illusory or derisory; the legal establishment of good faith as a new guiding principle of contract law. The determination of the content of the contract now seems to be the fruit of a collective work. Once considered ‘the enemy number one contract’ to the prism of the contractual freedom and binding force of the contract, the judge now seems to have some leeway to come to the rescue of the contract according to its nature or the situation of the contracting party. In the current law, the legislator substantially formalizes the prerogatives of the judge who will intervene frequently in the contractual universe even if his office is not clearly defined. He has now become a permanent player in the future of contemporary French contract law. It has a certain power of modulation and adaptation of the contract to the circumstance created or according to the circumstances. These prerogatives seem to make him the agent who will come to the aid of contractual efficiency and contractual durability if need be. This thesis will aim at dismantling through the reform, the variable place and the multiple purpose of the intervention of the judge in the contractual sphere while determining the contours and detours of the strengthening of his office in the optics to see if the extent of its interventionism is satisfactory.
